Democrats have been threatening it for quite some time, and today they pulled the trigger on suing President Donald Trump. The house committee is suing the President in federal court right before the Fourth of July holiday, over access to his tax returns. There is no doubt this is going to be a long, hard-fought legal battle on both sides.
The House Ways and Means Committee claims that it needs Trump’s taxes for an investigation into his compliance with certain tax laws. It’s asking the court to force Trump to hand over the documents.
Earlier this year, this same committee asked the IRS for six years of the President’s tax returns. They believed they had the right to them because of a law that states the IRS will furnish the returns of any taxpayer to a handful of lawmakers.
But The House Ways and Means Committee got the bad news when Treasury Secretary Steven Mnuchin denied their request. The Democrats fought back, the but the Justice Department backed the Treasury Secretary’s decision, claiming that it was an unprecedented use of congressional authority.
The lawsuit is claiming that Trump’s refusal to make his tax returns public is an effort to shield the President’s tax return information from Congressional scrutiny.
The lawsuit states: “Without reviewing the requested return materials, the Committee cannot ensure that the IRS’s audit process is functioning fairly and effectively, understand how provisions of the tax code are impacted by President Trump’s returns or exercise its legislative judgment to determine whether changes to the code may be warranted.”
It goes on to say that the President has “declined to follow the practice of every elected President since Richard Nixon of voluntarily disclosing their tax returns.”
